Welcome to eCard by ePorichoy ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at ecard.eporichoy.com, including our free digital business card creator tools, NFC virtual bio link profile designs, and our e-business card software license agreement. Our services are operated by RapidRoomz LLC.

By creating an account, upgrading to a premium subscription, or using our interactive digital bio link profile generator, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

1. Scope of Service & License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our virtual business card creator terms of use to design, host, and share your virtual business cards for professionals. You may use our service for personal or professional branding. Small business teams can use our system to manage multiple team member profiles under a single unified dashboard, subject to the seat limits of their active subscription plan.

2. Account Registration & Security

To access certain features of the platform, including our advanced lead capture system and dynamic analytics, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your login credentials.
• Accept sole responsibility for all activities that occur under your account.
• Notify us immediately at support@eporichoy.com of any unauthorized account access.

3. Subscription Fees, Billing, & Cancellations

We offer both free tiers and paid subscription plans (Pro, Business, Enterprise) to fit your professional needs.

• Pricing: Prices for our subscription plans are displayed in your local currency or US Dollars (USD) as configured on our platform. We reserve the right to modify pricing with 30 days' notice.
• Billing Cycle: Subscriptions are billed on a recurring monthly or yearly basis starting on the date of activation.
• Automatic Renewal: To avoid service disruption, plans automatically renew unless cancelled before the renewal date.
• Cancellation: You can cancel your premium subscription at any time via your user dashboard settings. Upon cancellation, your premium features remain active until the end of the current billing cycle.

4. Acceptable Use & Fair Use Policies

We aim to keep our platform safe and reliable for everyone. You agree not to use our digital business card creator tools to:

• Upload, post, or share content that is illegal, defamatory, pornographic, harassing, or promotes hate speech.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any company.
• Deceive visitors using malicious phishing forms via our lead capture fields.
• Distribute malware, viruses, or other harmful computer code.

4.1 Fair Use Policy for QR Code Generator

Our platform includes a built-in fair use policy for QR code generator scans and downloads. While we provide unlimited scans for standard business cards, we monitor for automated scraping, mass scanning attacks, and bulk registration of redirection links. Accounts found using automated scripts to generate or download hundreds of QR codes within short durations may have their API limits throttled or accounts suspended to protect system stability.

5. Intellectual Property & User Content

You retain all ownership rights to the profile images, company logos, social media links, and text content you upload to your terms of use for premium digital bio link profile for small business teams. By publishing a card, you grant us a worldwide, royalty-free, sublicable license to host, display, and distribute your card content strictly for the purpose of serving your profile to visitors.

All software code, graphics, interactive features, theme styles, website design, and logos of eCard by ePorichoy are the exclusive property of RapidRoomz LLC and are protected by United States and international copyright laws. You may not copy, reverse-engineer, or clone our themes or layouts.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall RapidRoomz LLC, its officers, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

• Your use or inability to use our digital business card platform.
• Unauthorized access to or alteration of your profile content or lead data.
• Any service interruptions or server downtime.
• Loss of business, clients, or revenue due to a non-functional card or scan failure.

Our total liability under these terms is limited to the amount you paid us in the twelve (12) months preceding the claim.

7. Termination of Service

We reserve the right to suspend or terminate your account and delete your digital profile pages without prior notice if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. You may terminate your account at any time by contacting our support team.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Delaware, and you consent to the personal jurisdiction and venue of such courts.

9. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of this page or via email. Your continued use of our platform after updates indicates your agreement to the revised Terms.
